REMINDER: Delivery of the 2019 ACH Rules


  • Every financial institution member will automatically receive one 2019 ACH Rule Book (membership benefit) which will be addressed to the attention of your ACH Department. Many have already been delivered.
  • If you placed an order for additional rule books, online access codes or digital apps, they will be delivered separately and prior to year-end (many in the next 7-10 days).
  • Rules access codes and digital apps will be delivered via email and will include a sample instructional message that can be shared with your staff and/or Origination customers.

Q.)  Is it ok to deposit business checks into the owner’s personal account?
A.)  A Bank of First Deposit makes a warranty in UCC 3 & 4 to the Paying Bank that it is "entitled to enforce" the check, meaning it provided value to the named payee. A BOFD breaches that warranty if a check payable to a named payee is deposited into any account other than an account titled under that specific payee’s name. In addition, depositing a check payable to a business into a personal account, or cashing a check payable to a business, has Bank Secrecy Act implications and could result in the depositary bank facilitating money laundering or income tax evasion on the part of its accountholder.
